Welcome to RefineAPI! These Terms of Use ("Terms") govern your access to and use of the RefineAPI service (the "Service") provided by Enkosi Ventures ("we," "us," or "our") via the RapidAPI marketplace. By using the Service, you agree to be bound by these Terms and the RapidAPI Marketplace Terms of Use.

1. Service Description

RefineAPI provides an application programming interface (API) that allows users to submit URLs of web articles to extract and receive structured data, including metadata, core text content, entities, and optionally, a Markdown version. The Service may utilize third-party Large Language Models (LLMs) for optional enhancement features. Due to the inherent complexities of web content and parsing technologies, RefineAPI may not perform perfectly on all articles or websites; accuracy and completeness of extracted data can vary.

2. License to Use

Subject to your compliance with these Terms and your active subscription plan on RapidAPI, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service according to the specifications of your chosen plan.

3. Acceptable Use

You agree not to use the Service:

For any illegal or unauthorized purpose.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others (including the content of fetched articles).
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate.
To submit or transmit viruses or any other type of malicious code.
To attempt to circumvent any security features of the Service or RapidAPI, including rate limits or plan restrictions beyond your subscription.
For a high volume of automated queries that place an unreasonable load on our infrastructure beyond the scope of your subscribed plan (our demo endpoint is subject to fair use and rate limiting).
To extract content from websites where you do not have the right to do so, or in a manner that violates the terms of service of those websites. You are solely responsible for ensuring you have the necessary permissions to access and process content from the URLs you submit.

4. Fees and Payment

Fees for the Service are governed by your subscription plan selected on the RapidAPI marketplace. All payments and billing are handled by RapidAPI.

5. Data Privacy and Usage

Please refer to our Data Usage and Privacy statement located at https://refineapi.com/privacy-policy/. By using AI enhancement features, you acknowledge that article content will be processed by third-party LLM providers subject to their terms. We do not store your submitted URLs or extracted content beyond immediate processing, nor do we use it for training our models or sell it.

6. Service Availability & Modifications

We strive to provide a reliable Service but do not guarantee that the Service will always be available, uninterrupted, or error-free. The nature of web content extraction means that performance and success rates can vary depending on the structure and accessibility of target websites. We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) with or without notice at any time.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE FOR ALL POSSIBLE INPUT URLS OR WEBSITE STRUCTURES. THE ACCURACY OF EXTRACTED DATA, ESPECIALLY WHEN RELYING ON AUTOMATED PARSING AND OPTIONAL AI ENHANCEMENTS, CANNOT BE GUARANTEED FOR EVERY WEB PAGE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ENKOSI VENTURES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY ERRORS, INACCURACIES OR OMISSIONS IN THE DATA PROVIDED BY THE SERVICE; (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Intellectual Property

The Service and its original content (excluding data extracted from user-provided URLs), features, and functionality are and will remain the exclusive property of Enkosi Ventures.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes, typically by updating the "Last Updated" date at the top of these Terms. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.
